These Terms & Conditions explain the basis on which Kim Hazzard Ltd provides training, consultancy and related services.

1. About these Terms & Conditions
These Terms & Conditions apply to training, consultancy, Dangerous Goods Safety Adviser (DGSA) services and other professional services supplied by Kim Hazzard Ltd.
By booking, purchasing or otherwise engaging Kim Hazzard Ltd to provide services, you agree to these Terms & Conditions. Where a booking is made by an employer or organisation on behalf of a delegate, that organisation is responsible for ensuring that the delegate is aware of any terms relevant to their attendance.
Any separately agreed written proposal, service agreement or contract may contain additional or different terms. Where there is a conflict, the terms specifically agreed in writing for that service will take precedence.
2. Bookings
Bookings are subject to availability and are not confirmed until accepted by Kim Hazzard Ltd.
Bookings may be made directly with us or, where available, through our website. You are responsible for ensuring that the information provided when making a booking is complete and accurate.
Where training has prerequisites, eligibility requirements or previous certification requirements, it is the responsibility of the person or organisation making the booking to provide the required information before the course.
3. Payment
Course fees and other charges are payable in accordance with the payment terms stated at the time of booking, on the relevant invoice or in an agreed proposal or service agreement.
Where a course is booked and paid for through our website, payment is taken at the time of booking.
Where payment is made by invoice, payment must be received by the due date shown on the invoice and, unless otherwise agreed in writing, before the training or service is provided.
Kim Hazzard Ltd reserves the right to withhold training certificates, examination results or other documentation until all amounts due have been paid.
4. Cancellations, transfers and delegate substitutions
We understand that circumstances can change and will always try to accommodate reasonable requests where possible.
Cancellations more than 14 calendar days before the course
Where written notice of cancellation is received more than 14 calendar days before the scheduled start date, the course fee will be refunded. Where Kim Hazzard Ltd has already incurred a specific non-refundable cost directly attributable to the booking, we reserve the right to deduct that cost from the refund. The booking may be transferred to another available Kim Hazzard Ltd course date. No cash refund will normally be provided. Any transfer is subject to availability and any non-refundable costs already incurred in connection with the original booking.Cancellations less than 7 calendar days before the course or non-attendance
Course fees are non-refundable. Where reasonably practicable, Kim Hazzard Ltd may, at its discretion, allow a booking to be transferred to a future course.Delegate substitutions
A booked delegate may be replaced by another suitable delegate from the same organisation at no additional charge, provided Kim Hazzard Ltd is notified at least 48 hours before the scheduled start of the course.The substitute delegate must meet any applicable course prerequisites or eligibility requirements. The organisation must provide the information reasonably required to update joining instructions, course administration, certification or examination arrangements and, where applicable, dietary or venue requirements.
Requests for substitutions received within 48 hours of the course will be considered where reasonably practicable but cannot be guaranteed.
Accommodation and travel
Delegates and customers are responsible for arranging and paying for their own accommodation, travel and other associated expenses unless expressly agreed otherwise in writing.
5. Cancellation or changes by Kim Hazzard Ltd
Occasionally, circumstances outside our reasonable control may require us to change a course date, venue, delivery method or other arrangements.
Where Kim Hazzard Ltd cancels a course, affected customers will be offered the choice of transferring their booking to another available course date or receiving a refund of the course fee paid.
Where reasonably possible, we will provide as much notice as we can of significant changes.
Kim Hazzard Ltd is not responsible for accommodation, travel or other costs separately booked or incurred by delegates or their organisations as a result of a course cancellation or change. We therefore recommend that flexible or refundable arrangements are considered when booking accommodation and travel.
6. Course attendance and delegate responsibilities
Delegates are expected to attend the full course and participate as reasonably required.
Delegates must follow any joining instructions provided by Kim Hazzard Ltd and comply with reasonable health, safety, security and venue requirements.
For live online training, delegates are responsible for having a suitable internet connection, appropriate equipment and an environment that enables them to participate fully in the course.
Kim Hazzard Ltd reserves the right to refuse continued participation where a delegate's behaviour is disruptive, unsafe or prevents the effective delivery of training to others.
7. Examinations, assessments and certification
Some courses include an examination or assessment and may be subject to requirements set by an external awarding, certification or training organisation.
Attendance on a course does not guarantee that a delegate will pass an examination or assessment or receive a particular result.
Where certification depends upon successful completion of an examination, assessment or other requirement, certificates will only be issued when the applicable requirements have been met.
Delegates and booking organisations are responsible for providing accurate information required for registration, examination and certification purposes.
Where examination or certification fees are charged separately from the course fee, this will be made clear at the time of booking or quotation.
8. Training materials and intellectual property
Training materials, presentations, course notes, handouts, templates and other materials supplied by Kim Hazzard Ltd remain the intellectual property of Kim Hazzard Ltd or the relevant third-party rights holder unless stated otherwise.
Materials supplied to delegates are for their own internal learning and reference purposes and must not be copied, reproduced, distributed, sold, published or used to deliver training to others without prior written permission.
Recording, filming or photographing training sessions or reproducing substantial parts of live online training is not permitted without prior agreement from Kim Hazzard Ltd.
9. Consultancy and DGSA services
Consultancy and Dangerous Goods Safety Adviser (DGSA) services are provided with reasonable skill and care and on the basis of the information available to Kim Hazzard Ltd at the time the advice is given.
The scope of any ongoing DGSA appointment, audit, consultancy project or other professional service will be as agreed in the relevant proposal, appointment, service agreement or other written correspondence.
Advice provided relates to the circumstances and information presented at the time and may need to be reviewed if regulations, operations, products, classifications, quantities, routes or other relevant circumstances change.
10. Information provided by clients
Clients are responsible for providing complete, accurate and up-to-date information reasonably required for Kim Hazzard Ltd to provide training, consultancy or DGSA services.
This may include product classifications, UN numbers, quantities, Safety Data Sheets, test information, packaging information, transport documents, photographs, operational procedures and other relevant records.
Kim Hazzard Ltd is entitled to rely on information supplied by the client, its employees, suppliers or other representatives unless there is an obvious reason to question its accuracy.
Where information is incomplete, inaccurate or changes after advice has been provided, the client should notify Kim Hazzard Ltd as soon as reasonably practicable so that the advice can be reviewed where necessary.
11. Operational responsibility
Advice, audits, document reviews and DGSA support provided by Kim Hazzard Ltd are intended to assist clients in meeting their dangerous goods and transport compliance obligations.
Unless expressly agreed otherwise in writing, responsibility for the client's day-to-day operations, classification of goods, preparation and presentation of consignments, selection and use of packaging, loading, securing, documentation and decisions to offer goods for transport remains with the client and the persons carrying out those functions.
Nothing in our services removes or replaces the legal duties that may apply to a consignor, shipper, carrier, packer, loader, operator, employer or other person under applicable dangerous goods or transport legislation.
12. Limitation of liability
Kim Hazzard Ltd will provide its services with reasonable skill and care.
To the fullest extent permitted by law, Kim Hazzard Ltd will not be liable for indirect or consequential loss, loss of profit, loss of business or loss arising from information supplied by a client or third party that is incomplete, inaccurate or out of date.
Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
13. Events outside our reasonable control
Kim Hazzard Ltd will not be responsible for delay or failure to provide a service where this results from circumstances outside our reasonable control.
These may include severe weather, transport disruption, venue closure, illness, power or internet failure, industrial action, government restrictions or other unforeseen events.
Where such circumstances affect a course or service, we will make reasonable efforts to inform affected customers and arrange a suitable alternative where possible.
14. Data protection and privacy
Personal information provided in connection with bookings, training, examinations, certification, consultancy and other services will be handled in accordance with applicable data protection law and our Privacy Policy.

15. Changes to these Terms & Conditions
We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal and regulatory requirements.
The version applicable to a booking or service will normally be the version in effect when that booking or service was agreed, unless a change is required by law or otherwise agreed in writing.
The date shown at the top of this page indicates when these Terms & Conditions were last updated.
16. Governing law and contact details
These Terms & Conditions and any dispute or claim arising from them are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any rights that cannot lawfully be excluded.
